GENERAL INFORMATION AND MANDATORY DISCLOSURES
CONTROLLER The controller responsible for data processing on this website is:
Filmrausch Moabit e.V. Jörg Schwiemann Lehrter Str. 35 10557 Berlin Germany Email: info@filmrausch.de
The controller decides alone or jointly with others on the purposes and means of processing personal data (e.g. names, contact details, etc.).
WITHDRAWAL OF YOUR CONSENT TO DATA PROCESSING Some data processing operations are only possible with your express consent. You may withdraw your already given consent at any time. For withdrawal, an informal notification by email is sufficient. The lawfulness of data processing carried out until the withdrawal remains unaffected by the withdrawal.
RIGHT TO LODGE A COMPLAINT WITH THE COMPETENT SUPERVISORY AUTHORITY In the event of a data protection breach, you as a data subject have the right to lodge a complaint with the competent supervisory authority. The competent supervisory authority for data protection issues is the state data protection commissioner of the federal state in which our organisation is headquartered. A list of data protection commissioners and their contact details can be found at the following link: https://www.bfdi.bund.de/DE/Infothek/Anschriften_Links/anschriften_links-node.html.
RIGHT TO DATA PORTABILITY You have the right to receive data that we process automatically on the basis of your consent or in performance of a contract, delivered to you or to a third party in a common, machine-readable format. If you request direct transfer of the data to another controller, this will only take place to the extent technically feasible.
RIGHT TO ACCESS, RECTIFICATION, BLOCKING, ERASURE Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of data processing, and possibly a right to rectification, blocking or erasure of this data. For this purpose and for further questions on personal data, you can contact us at any time using the contact details provided above.
SSL OR TLS ENCRYPTION For security reasons and to protect the transmission of confidential content that you send to us as the site operator, this website uses SSL or TLS encryption. You can recognise an encrypted connection by the “https://” in your browser’s address bar and by the lock icon in the browser bar.
SERVER LOG FILES Our website provider (IN-Berlin e.V., Lehrter Str. 53, 10557 Berlin) automatically collects and stores information that your browser automatically transmits in “server log files”. This includes:
- Browser type and browser version
- Operating system used
- Referrer URL
- Host name of the accessing computer
- Time of the server request
- IP address
These data are not merged with other data sources. The legal basis for this data processing is Art. 6(1)(b) GDPR, which permits the processing of data for the performance of a contract or pre-contractual measures.
The retention period or anonymisation of IP addresses in the log files is set to 7 days. Justification from IN-Berlin e.V.: “In the event of attacks on our web servers, we would no longer be able to see the attackers’ IP addresses in the log files. Protecting the infrastructure is our legitimate interest in temporarily storing IP addresses within the permitted parameters.”
The privacy policy of IN-Berlin e.V. can be found here: www.in-berlin.de/datenschutz.
NEWSLETTER The following information informs you about the contents of our newsletter as well as the registration, dispatch and statistical evaluation procedures and your objection rights. By subscribing to our newsletter, you agree to receive it and to the described procedures.
Contents of the newsletter: We send newsletters, emails and other electronic notifications with advertising information (hereinafter “newsletter”) only with the consent of the recipients or on the basis of a legal permission. If the contents of the newsletter are specifically described in the context of registration, they are decisive for the consent of the users. Otherwise, our newsletters contain information about our services and us.
Double opt-in and logging: Registration for our newsletter takes place in a so-called double opt-in procedure. This means that after registration you will receive an email asking you to confirm your registration. This confirmation is necessary so that no one can register with other people’s email addresses. Registrations for the newsletter are logged in order to prove the registration process in accordance with legal requirements. This includes storing the time of registration and confirmation as well as the IP address. Changes to your data stored with the mailing service provider are also logged.
Registration data: To subscribe to the newsletter, it is sufficient to provide your email address. Optionally, we ask you to provide a name for personal addressing in the newsletter.
The dispatch of the newsletter and the associated performance measurement are based on the consent of the recipients pursuant to Art. 6(1)(a), Art. 7 GDPR in conjunction with § 7(2) No. 3 UWG or, if consent is not required, on the basis of our legitimate interests in direct marketing pursuant to Art. 6(1)(f) GDPR in conjunction with § 7(3) UWG.
The logging of the registration procedure is based on our legitimate interests pursuant to Art. 6(1)(f) GDPR. Our interest lies in the use of a user-friendly and secure newsletter system that serves both our business interests and the expectations of users and allows us to prove consent.
Cancellation/revocation – You can cancel receipt of our newsletter at any time, i.e. revoke your consent. A link to unsubscribe from the newsletter can be found at the end of each newsletter. We may store unsubscribed email addresses for up to three years based on our legitimate interests before deleting them in order to prove a previously given consent. The processing of this data is limited to the purpose of possible defence against claims. An individual erasure request is possible at any time, provided that the former existence of consent is confirmed at the same time.
NEWSLETTER – MAILCHIMP The newsletter is sent via the mailing service provider “MailChimp”, a newsletter mailing platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA. You can view the privacy policy of the mailing service provider here: https://mailchimp.com/legal/privacy/.
The Rocket Science Group LLC d/b/a MailChimp is certified under the EU-U.S. Data Privacy Framework (DPF) and thereby provides a guarantee of compliance with the European level of data protection. The mailing service provider is used on the basis of our legitimate interests pursuant to Art. 6(1)(f) GDPR and a data processing agreement pursuant to Art. 28(3) sentence 1 GDPR.
The mailing service provider may use the recipients’ data in pseudonymised form, i.e. without attribution to a user, to optimise or improve its own services, e.g. for technical optimisation of dispatch and presentation of the newsletters or for statistical purposes. However, the mailing service provider does not use the data of our newsletter recipients to contact them itself or to pass the data on to third parties.
NEWSLETTER – PERFORMANCE MEASUREMENT The newsletters contain a so-called “web beacon”, i.e. a pixel-sized file that is retrieved from our server or, if we use a mailing service provider, from its server when the newsletter is opened. As part of this retrieval, technical information is initially collected, such as information about the browser and your system, as well as your IP address and the time of retrieval.
This information is used to technically improve the services based on the technical data or the target groups and their reading behaviour based on their retrieval locations (which can be determined with the help of the IP address) or access times. The statistical surveys also include determining whether the newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to the individual newsletter recipients. However, neither we nor, if applicable, the mailing service provider aim to observe individual users. The evaluations serve us much more to recognise the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.
A separate revocation of performance measurement is unfortunately not possible; in this case, the entire newsletter subscription must be cancelled.
