SERVER LOG FILES

Our website provider (IN-Berlin e.V., Lehrter Str. 53, 10557 Berlin) automatically collects and stores information in server log files that your browser automatically transmits to us. This includes:

This data is not merged with other data sources. The basis for data processing is Art. 6 (1) lit. b GDPR, which permits the processing of data for the fulfilment of a contract or pre-contractual measures.

The deletion period or anonymisation of IP addresses in the log files is set at 7 days. Reasoning from IN-Berlin e.V.: ‘In the event of attacks on our web servers, we no longer see the IP addresses of the attackers in the log files. The protection of our infrastructure is our legitimate interest in storing IP addresses for a short period of time within the permitted parameters.’

NEWSLETTER

The following information provides details about the content of our newsletter, the registration and dispatch process, statistical analysis and your rights of objection. By subscribing to our newsletter, you agree to receive it and to the procedures described.

Content of the newsletter: We send newsletters, emails and other electronic notifications with promotional information (hereinafter ‘newsletters’) only with the consent of the recipients or with legal permission. If the content of the newsletter is specifically described during the registration process, this description is decisive for the consent of the users. In addition, our newsletters contain information about our services and us.

Double opt-in and logging: Registration for our newsletter is carried out using a double opt-in procedure. This means that after registering, you will receive an email asking you to confirm your registration. This confirmation is necessary to prevent anyone from registering with someone else’s email address. Newsletter registrations are logged in order to be able to verify the registration process in accordance with legal requirements. This includes storing the time of registration and confirmation, as well as the IP address. Changes to your data stored by the mailing service provider are also logged.

Registration data: To register for the newsletter, it is sufficient to provide your email address. Optionally, we ask you to provide a name for personalised communication in the newsletter.

The newsletter is sent and its success measured on the basis of the recipient’s consent in accordance with Art. 6 (1) (a) Art. 7 GDPR in conjunction with Section 7 (2) No. 3 UWG (German Unfair Competition Act) or, if consent is not required, on the basis of our legitimate interests in direct marketing in accordance with Art. 6 (1) lit. f GDPR in conjunction with Section 7 (3) UWG.

The registration process is logged on the basis of our legitimate interests pursuant to Art. 6 (1) (f) GDPR. Our interest is in using a user-friendly and secure newsletter system that serves our business interests, meets user expectations and also allows us to prove consent.

Cancellation/revocation – You can cancel your subscription to our newsletter at any time, i.e. revoke your consent. You will find a link to cancel the newsletter at the end of each newsletter. We may store the unsubscribed email addresses for up to three years on the basis of our legitimate interests before deleting them in order to be able to prove that consent was previously given. The processing of this data is limited to the purpose of a possible defence against claims. An individual request for deletion is possible at any time, provided that the former existence of consent is confirmed at the same time.

NEWSLETTER – MAILCHIMP

The newsletter is sent using the mailing service provider ‘MailChimp’, a newsletter mailing platform provided by the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA. You can view the mailing service provider’s privacy policy here: https://mailchimp.com/legal/privacy/. The Rocket Science Group LLC d/b/a MailChimp is certified under the Privacy Shield Agreement and thus offers a guarantee that it complies with European data protection standards (https://www.privacyshield.gov/participant?id=a2zt0000000TO6hAAG&status=Active). The mailing service provider is used on the basis of our legitimate interests pursuant to Art. 6 (1) lit. f GDPR and a data processing agreement pursuant to Art. 28 (3) sentence 1 GDPR.

The shipping service provider may use the recipients’ data in pseudonymous form, i.e. without assigning it to a user, to optimise or improve its own services, e.g. for technical optimisation of the dispatch and presentation of the newsletters or for statistical purposes. However, the shipping service provider does not use the data of our newsletter recipients to write to them itself or to pass the data on to third parties.

NEWSLETTER – SUCCESS MEASUREMENT

The newsletters contain a so-called ‘web beacon’, i.e. a pixel-sized file that is retrieved from our server or, if we use a mailing service provider, from their server when the newsletter is opened. During this retrieval, technical information such as information about your browser and your system, as well as your IP address and the time of retrieval, is initially collected.

This information is used for the technical improvement of the services based on the technical data or the target groups and their reading behaviour based on their retrieval locations (which can be determined with the help of the IP address) or access times. The statistical surveys also include determining whether the newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to individual newsletter recipients. However, it is neither our intention nor, if used, that of the shipping service provider to observe individual users. The evaluations serve us much more to recognise the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.

Unfortunately, it is not possible to revoke the performance measurement separately; in this case, the entire newsletter subscription must be cancelled.

Our website uses YouTube plugins via kinoheld integration for the integration and display of video content. The video portal is provided by YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA.

When you visit a page with an integrated YouTube plugin, a connection to the YouTube servers is established. YouTube thereby learns which of our pages you have visited.

YouTube can assign your surfing behaviour directly to your personal profile if you are logged into your YouTube account. You can prevent this by logging out beforehand.

YouTube is used in the interest of an appealing presentation of our online offerings. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR.
